Electronic disclosure support

Electronic Disclosure Support — N263 & N264

Map supplied electronic-document sources and organise technical information into reviewable working material.

For England and Wales civil matters where the customer or adviser has identified N263, N264 or a related electronic-disclosure requirement.

What the service does

One technical route for related N263 and N264 material

HMCTS publishes N263 as the Disclosure Report and lists N264 as the Electronic Documents Questionnaire. Practice Direction 31B explains that parties may use the questionnaire to exchange information about electronic documents.

We can organise customer-supplied system, source and technical inventory facts. We do not decide what searches or disclosure are legally required.

N263 and N264 have related but distinct purposes

The N263 form records disclosure-report information and refers to filing an exchanged N264 where applicable. Practice Direction 31B describes the N264 questionnaire as an information tool for electronic-document discussions.

The responsible customer or adviser determines applicability and every legal answer.

Technical preparation, not disclosure strategy

Scope may include mapping supplied data sources, recording systems, organising mailbox information and preparing a technical inventory.

We do not determine proportionality, required searches, legal relevance, privilege, search terms as strategy or what should be agreed with another party.

Clear service boundary

Electronic-disclosure decisions remain with the responsible person

Disclosure Assist does not decide required searches, proportionality, disclosure obligations, legal relevance, privilege, search terms as strategy, agreements with another party or any substantive answer. We do not sign, verify, file or serve the forms.

Disclosure Assist provides technical and administrative document support. We are not a solicitors' firm and do not provide legal advice or legal representation.
